This includes a positive drug test, refusal to test, or an alcohol test with a BAC of 0.04 or higher. The driver must first complete an evaluation with a Substance Abuse Professional (SAP) and any recommended treatment before the RTD test can be administered.
Yes. Under 49 CFR Part 40 Subpart O, a driver must complete an evaluation with a DOT-qualified Substance Abuse Professional (SAP) before taking a return-to-duty test. The SAP will recommend education and/or treatment. Only after completing the SAP's recommendations can the return-to-duty test be ordered and taken.

After receiving a verified negative return-to-duty test result, the driver is cleared to return to safety-sensitive functions. However, the SAP will also prescribe a follow-up testing plan — a minimum of 6 unannounced tests in the first 12 months, with possible extension up to 60 months. The RTD result and follow-up plan are reported to the FMCSA Clearinghouse.

Yes. The return-to-duty test result is reported to the FMCSA Drug and Alcohol Clearinghouse. A negative RTD result, along with completion of the SAP process, changes the driver's Clearinghouse status and allows employers to see that the driver has completed the return-to-duty process.
